Handling of unsolicited submission of ideas and offers

SCANIA CV AB and its employees absolutely reject any unsolicited submissions of ideas and offers (as defined below). Neither SCANIA CV AB nor its employees will take, confirm, accept, process, inspect, analyze or consider in any other manner ideas or offers that have been submitted unsolicitedly. We therefore ask you to refrain from submitting unsolicited ideas and offers to SCANIA CV AB or its employees in any case.

Ideas and offers in the sense relevant here include, for example, suggestions, concepts, proposals, plans, works, papers, materials, documents, art, drawings, sketches, pictures, photographs, sculptures, models, data sets and any other comparable content, irrespective of the form and irrespective of the objectives or purpose pursued by the submission, such as, for example, for advertisement purposes, for marketing campaigns or campaigns to improve sales or product services, as creative material, for the purpose of initiating a cooperation, for product development or for strategies, with this list being explicitly non-exhaustive.

Should you have any doubts regarding the classification as an idea or offer in the above sense, we ask you to please refrain from unsolicitedly submitting contents to SCANIA CV AB or its employees also in this case. A submission can only correspond to the will of SCANIA CV AB or its employees if we explicitly and unambiguously ask you to do so and if you send your ideas and offers to us only in response to our request.

This policy clarifies the position of SCANIA CV AB regarding the unsolicited submission of ideas and offers and shall avoid potential misunderstandings, unclarities and disputes, in particular in case contents, products, product features, services or functions generated or developed independently by SCANIA CV AB appear to correspond to or to be similar to an idea submitted unsolicitedly or an offer submitted unsolicitedly as a whole or in part.

Should you still unsolicitedly submit ideas and offers to SCANIA CV AB or its employees, contrary to the stipulations of this policy, you agree to the below terms that will apply irrespective of the content of your unsolicited sending or the statements comprised in potential accompanying documents or your other communication.

You agree that:

• There are no claims against SCANIA CV AB and/or its employees for compensation or any other consideration for an unsolicited submission of ideas or offers;
• SCANIA CV AB and/or its employees may proceed with an idea submitted unsolicitedly or such an offer as they see fit, which in particular includes the immediate deletion and destruction of the idea or the offer, as well as the involved correspondence without examining the content; in this regard, the sender waives any claims against SCANIA CV AB and/or its employees regarding the unsolicitedly submitted idea or such an offer, in particular possible claims for surrender or damages;
• SCANIA CV AB and/or its employees are under no obligation to inspect, examine or otherwise consider an unsolicitedly submitted idea or such an offer;
• SCANIA CV AB and/or its employees are under no confidentiality obligation with regard to an unsolicitedly submitted idea or such an offer and the involved correspondence.

Feedback, questions or other concerns in connection with already existing products, offers or services of SCANIA CV AB are no such ideas or offers in the above sense. However, such content submitted to SCANIA CV AB or its employees is not considered confidential and can be used freely by SCANIA CV AB and its employees.
